MR LB LABUSCHAGNE (DA) TO ASK THE MINISTER OF FOREIGN AFFAIRS:

(1) How many incidents of an alleged criminal nature involving diplomats and other persons who claimed diplomatic immunity occurred in (a) 2000, (b) 2001, (c) 2002, (d) 2003 and (e) 2004;

(2) Whether she is considering restricting the granting of diplomatic immunity to accredited diplomats, their spouses or registered partners and minor dependants only; if not, why not; if so, what are the relevant details;

(3) Whether she will make a statement on the matter? N1469E

REPLY:

(1) It is not clear from the question which diplomats the Honourable Member is referring to; whether South African diplomats abroad, or the diplomats in South Africa from other countries.

(2) No, because in terms of the Diplomatic Immunities and Privileges Act, (Act No 37 of 2001) which incorporates the Vienna Convention on Diplomatic Relations, 1961, the Minister is under legal obligation to grant immunities and privileges to diplomatic agents and their dependants.

(3) No.
