Agreements regarding the Repatriation of South African Nationals
serving Sentences of Imprisonment in Foreign Countries NATIONAL ASSEMBLY FOR
WRITTEN REPLY QUESTION NO: 1279 PUBLISHED IN INTERNAL QUESTION
PAPER NO 26 OF 19 AUGUST 2005 Mr J Selfe (DA) to ask the Minister of Foreign
Affairs:
(1) Whether South Africa has (a) negotiated and (b) signed or (c)
ratified any treaties, or acceded to any protocols with any other countries, regarding
the repatriation of South African nationals serving sentences of imprisonment
in foreign countries, to serve this imprisonment in South Africa; if not, why
not; if so, (i) with which countries and (ii) what is the nature of the treaty
or protocol in each case;
(2) whether any representations have been made to
her or her department in this regard; if so, what was the (a) nature of the representations
and (b) response thereto in each case?
N1669E REPLY: (1)
No. (2) Yes. a) Numerous representations have been received by Government.
These appeals vary in nature from prisoner to prisoner and other interest groups.
Appeals have included requests for interventions, pardons, lessening of sentences,
prisoner transfer agreements, etc. b) The Department's response has generally
been in terms of policy as stated in paragraph (1) above. However, where requests
for release on humanitarian grounds have been received, these have been considered
according to the approved Departmental criteria.
